Migration flows and the right to cross borders are pressing issues, given the human rights violations of individuals and groups experiencing migration. The various international treaties and conventions appear insufficient to guarantee rights. At the same time, the advent of information technologies has brought to the forefront the homo digital migrant, now subject to the constraints of digital control beyond physical borders. This study aims to analyze the impacts of Artificial Intelligence on migration flows from the perspective of human rights protection. It is based on the hypothesis that new technologies require renewed reflection and action from an ethical and legal perspective, highlighting the need for regulatory frameworks that protect the human rights of migrants. The methodology employed is hybrid, descriptive-bibliographicalexplanatory, applying Aristotelian Topics to constantly question them. As a result, the need for a standard for the human rights of migrants was recognized, as progress is only possible in conjunction with ethics, techno-ethics and legal practice.
