The objectification of civil liability has been the product of the gain of complexity of intersubjective relationship within the mass and consumption society. It has been soon passed from the merely privatist spaces interactions to enter the areas of environmental law. This article, in bibliographical and case law review, analyzes the evolution and reception of this process in Brazilian law. The theses which were developed initially in the assertion of state liability were designing for the establishment of an objective duty to repair the damage to the environment. If the Constitution, laws and courts have been recognizing the objective liability, there are still discussions whether it is with the requirement of a causal connection (theory of created risk) or as a repairability without any exclusion clause (theory of integral risk). To a large extent, these different interpretations have ideological inspiration. The theory of integral risk is ideological and telelogically better suited to overcome the logic of endless appropriation of nature, ensuring the effectiveness of the right to a healthy environment for the presents and future generations.
