Education, cell phones and legislation: analysis of Law No. 15.100/2025 on the use of cell phones in schools

Abstract

The Digital Revolution has imposed new challenges to basic education, especially regarding the integration and control of technology use in the school environment. In light of this scenario, the present article analyzes the actions of the Brazilian Legislative Power through Law Nº 15.100, dated January 13, 2025, which prohibits the use of cell phones in schools, with the aim of preserving concentration, discipline, and the quality of education. The central problem of the research consists of investigating how the Legislative has responded to the impacts of hyperconnectivity, especially in the field of education, and whether it has constitutional competence to legislate on educational public policies. The general objective is to understand the legitimacy and limits of legislative action in this context, taking Law No. 15,100/2025 as a case study. The methodology used is documentary and jurisprudential analysis, based on decisions from the Supreme Federal Court, the Court of Justice of the State of São Paulo, and the legislative monitoring of the bill's progress. The results indicate that the legislative action was legitimate, respecting the constitutional limits of the separation of powers, and that subsequent regulation by the Ministry of Education reinforces the need for cooperation between the branches of government for the implementation of public policies. It is concluded that Parliament plays an essential role in mediating the social effects of technology, especially in times of accelerated digital transition.
