This article deals with the (non)application of restorative justice to white-collar crimes, proposing to analyze the feasibility, challenges, and limitations of this application. The proposed problem is expressed in the following question: to what extent can restorative justice be employed in so-called white-collar crimes? The hypothesis is that, despite significant practical and theoretical obstacles, restorative justice is fully applicable to white-collar crimes. The objective of this research is to investigate whether, and to what extent, restorative justice can be applied to white-collar crimes. The method adopted is hypothetical-deductive, conducted through a theoretical and exploratory literature review with a qualitative approach. This study has two chapters, which reflect the specific objectives. The first chapter analyzes general notions of restorative justice and white-collar crimes; The second section analyzes white-collar crimes from the perspective of restorative justice, assessing whether the application of this form of justice to these crimes represents a structural limitation of the proposal or merely a barrier that can be overcome. It also identifies and discusses the main challenges facing the application of the restorative model regarding the role of victims and offenders in these crimes. The main conclusions indicate that, even in the face of barriers such as the difficulty in identifying victims and offenders, it is entirely possible to apply restorative justice to white-collar crimes without sacrificing accountability, reparation, and prevention.
