Os Requisitos e os Limites para Aplicação das Medidas Coercitivas sob a Luz do Art. 139, IV, do Código de Processo Civil

This article intends to establish the requirements for the application of coercive measures, article 139, item IV, of the Code of Civil Procedure and, by consecration, to indicate the possible types of atypical measures applicable in the enforcement process. Furthermore, it has the purpose of delineating the evolution of jurisdiction, with the scope of making a relation with the performance of the jurisdictional power and the limits of the coercive measures. In addition, it seeks to analyze the conflict between norms in the light of article 489, § 2, of the Civil Procedure Diploma, in order to verify the subsistence of the conflicting norm. Finally, it is intended to make explicit the weighting in the event of a collision between principles and, as a corollary, to present an adequate solution to the collision between them.
From these ideas, it is worth noting that the article was developed by the method of bibliographical revision, combined with the legal order of the country and decisions emanating from the Judiciary.
