Special retirement from EC n. 103/2019 and the incompatibility of the new regulations in the constitutional pension protection program

In 1988, a welfare program was also elected based on social security legal agreements, inspired by social justice and the founding premise of human dignity. The ideals of protection and inclusion drive its foundations and reasons for existence, specifically with regard to the planned benefit package provided for in federal social security legislation. This article aims to investigate the contradictory effects of the new provisions of the special retirement benefit established by the new reform of the national social security system through Constitutional Amendment (CA) No. 103 of November 13, 2019. The problem that has arisen and needs to be understood lies in the establishment of new objective criteria that are incompatible with the system as a whole and which, unfortunately, will result in the lack of protection and weakening of the core activity of social security technology as a whole. To this end, analytical, deductive, and descriptive methods will be used, along with doctrinal and jurisprudential research. The aim is to demonstrate that the new constitutional regulations in this regard are incompatible with the founding guidelines of social protection that nourish the complex Brazilian social security system, notably for rights holders with proven exposure to risk agents.
