Proteção Jurídica ao Meio Ambiente do Trabalho Saudável e Seguro Ante os Desafios da Globalização Econômica

Abstract

The main objective of this article is to identify the contemporary problem of legal protection of the safe working environment in the hegemonic economic globalization.

The theoretical reference adopted (technical studies, doctrine, legislation and reality data), submitted to the systematic analysis of, identified as current problems that affect the work environment: the increasing control of legislative production by the interests of capital over social and environmental issues related to labo and the precariousness of the work environment, this, generating high rates of accidents at work, occupational diseases and work diseases in Brazil.

The article is methodologically structured on 5 related topics: Control of internal sovereignty by neoliberal globalization, Control of legislative production by neoliberal globalization, Globalization and environment, Globalization and the environment of work and Challenges of the Right to protection of collective interests and concerning the environment of work, besides the introduction and the main conclusions.

To the problems, the article presents answers of a political-pedagogical nature (such as the permanent promotion of socio-environmental education) and of legal-normative nature ( edition of laws controlling the abuses of economic power) – efficient responses to guarantee to the law the emancipatory role of these questions and answers capable of subjecting capital to the governance of fundamental rights.
