There are several issues that, in the ordinary practice, are raised about the intervention of the accused during the oral trial. First, as soon as the plenary begins, the place where he should be located, whether next to his lawyer or in what is known as “bench”. Secondly, the moment when he must declare. And finally, the scope and content of the right to the final word. All these questions are related to the fundamental right of defence. And, of course, the right to be duly informed prior to his declaration of his rights and the criminal acts attributed to him. These are the issues that will be analysed in the next pages.
