The right to a minimum living income as a right to social protection against poverty in Spain: compliance with international standards

The protection of vulnerable people in situations of need is a constitutional order addressed to the public authorities, recognized in international treaties and constitutions. In Spain, this constitutional mandate has been partially implemented by the state parliament through the approval of the Minimum Living Income Law. This paper proposes the need for constitutional and legal regulation of the right to a minimum living income for the most vulnerable. One of its objectives is to critically examine some of the subjective and objective elements that comprise the right to a minimum living income in Spanish legislation. Another objective of this paper is to identify some of the current international standards on social protection through a minimum income guarantee system that are binding on the States Parties. Having achieved this objective, the identification of which are those international standards, one of the results and conclusions obtained in this study is to specify which aspects of the international standards are not met by the Spanish State and what measures it must adopt to comply with them.
