A qualificadora de feminicídio no Código Penal brasileiro: Uma análise acerca de suas elementares e possível natureza

Abstract

This article is an investigation into the nature of the aggravation3 of feminicide, carried out from a specialized legislative, doctrinal and theoretical perspective. The question we seek to answer is whether the nature of the aggravation of feminicide is objective or subjective, and, from there, what are the doctrinal and practical implications of one position or another. Considering the complexity of the social phenomenon of feminicide, the analysis must make use of specialized literature so that we can, initially, locate the elementary aspects of the type. To this end, it will be necessary to analyze the uses of the expressions woman, gender, and sex in current criminal legislation. Secondly, it is important to clarify the origin of the Brazilian criminal conduct of feminicide, as well as its implementation process in the Penal Code. Finally, we will analyze the nature of the aggravation, seeking to demonstrate how the conduct has been doctrinally understood and where we stand regarding the analysis from a specialized and socially committed gender theory. Regarding the results achieved, the study points to a certain doctrinal confusion regarding the nature of the qualifier, mainly based on definitions that are not very concerned with the articulation between Law, gender theories and, consequently, the significance of the social phenomenon that constitutes a feminicide. Methodologically, this is a documentary investigation and bibliographic review, the method used so that we could answer the proposed scientific problem is based on deductive reasoning.
