Abstract

A “controlled delivery” in trafficking and international smuggling of persons allowed in the Palermo Convention brings obvious conflict with respect for human dignity due to the discretion of the police authority. This article aims to analyze, on the permissive of “controlled delivery” of victims under the additional protocol to the Palermo Convention, to what extent it is necessary that the authorities allow the risk to physical and/or sexual integrity of one or a few victims of trafficking and smuggling of people for the sake of obtaining evidence and the best time to justify the delay of action to achieve a substantial conviction of those involved or covering more offenders. the question arises whether the physical and sexual dignity of victims put in a position of “controlled delivery” have received primacy in favor of the proof of claim harvest. The final argument is that the authorities, by using the “controlled surrender” of the victims, have neglected the security and dignity of the person in the search of evidence, not providing effective mechanisms to guarantee the physical and moral integrity of the person during the investigations trafficking in human beings and smuggling of people.
